By means of the present writ petition the petitioner has approached this Court for issuing a writ of mandamus directing the respondents to pay all the retiral benefits including pension to the petitioner. The petitioner submits that the petitioner who was working in the Nagar Nigam, retired from service on 31.1.2005. The relevant papers have been submitted by the petitoner but the same have not been paid up till date.
After hearing the learned counsel for the petitoner and Sri B.S. Pankaj who appears for respondents no.2 and 3, it is provided that if the petitioner submits a representation annexing the document thereto to respondent no.2 within a period of two weeks, the respondent no.2 is directed to consider the claim of the petitioner for payment of retiral benefits and the respondent no.2 shall decide the same by a speaking and reasoned order within six weeks from the date of making of the representation. It is further provided that if ultimately respondent no.2 comes to the conclusion that the petitioner is entitled for the amount, the same shall be paid to the petitioner within a period of one week thereafter.
With these observations the writ petition is disposed of.
