This writ petition has been filed for restraining the respondent police authorities from making any investigation and disturbing the peaceful life and personal liberty of the petitioner and his family members and also for a direction to the respondents not to arrest the petitioner and his family members for harassment.
The writ petition has been filed on mere apprehension that the petitioner or his family members may be arrested in view of the fact that the investigating agency has some evidence in respect of a person named S. Chakraborty alias Dada involved in some crime, who made telephone calls to the petitioner. It is submitted by the petitioner that the said Shri Chakraborty has been living in part of the premises where the petitioner is residing.
We agree with the learned Standing Counsel appearing for the respondents that in such a fact situation, this Court cannot stop the investigation nor we can issue any direction to the respondents investigating agency not to interrogate the petitioner particularly in view of the fact that it is admitted by the petitioner himself that he was having some telephonic conversation with the said Shri S. Chakraborty. We do not find any force in the writ petition. It is accordingly dismissed.
