1. The petitioners had taken loan from UP Financial Corporation (the Corporation) in the year 1986. The petitioner could not pay the loan and his unit was sold by the Corporation in 1996. Subsequently the Corporation started recovery proceedings for the remaining amount. The petitioners filed an application for one time settlement. This application was rejected on 25.9.2004 directing the petitioner for enhancing the proposal. Thereafter, the petitioner has filed this writ petition for one time settlement.
2. We have heard Counsel for the petitioners, Standing Counsel and Sri A Khan, counsel for the respondents.
3. In the circumstances of the case, the petitioners may file a representation before respondent no. 3. In case the representation is filed, it may be decided by respondent no. 3 by a speaking order, if possible, within three months from the date of receipt of the representation. The petitioner will file a certified copy of this order; necessary documents and a duly stamped self-addressed envelope along with his representation. Respondent no. 3 after taking decision will communicate the same to the petitioner.
4. With these directions the writ petition is disposed of.
