Heard counsel for the parties and perused the record.  

Despite time being granted on 16.2.2005 for filing counter affidavit within four weeks, the respondents have filed no counter affidavit.

The petitioners applied for the post of Peons in the Nav Prakash Uchchattar Madhyamik Vidyalaya, Bhawaniganj, Jaunpur in pursuance of an advertisement dated 2.9.2004 to this effect. After going through the selection process and interview they were issued appointment letters on 26.9.2002 by the Principal of the aforesaid institution. They joined their services on 1.10.2002. The Principal of the aforesaid institution sent all the relevant papers to the District Inspector of Schools on 5.10.2002 for financial approval. The District Inspector of Schools stopped the payment of salary of the petitioners on the ground that some enquiry by Mahalekhadhikari is going on regarding appointments in District Jaunpur. The enquiry has been completed but the payment of salary of the petitioners which was discontinued is still awaited.    

     The counsel for the petitioners submits that the petitioners have made a representation dated 10.8.2003 (Annexure 11 to the writ petition) in this regard to respondent no. 3 but the same remains unactioned till date. He prays that since no counter affidavit has been filed a direction may be issued to respondent no. 3 to decide the aforesaid representation of the petitioner within a time bound period to be fixed by this Court.

Standing Counsel has no objection to this prayer.

In this view of the matter respondent no. 3 is directed to decide the representation of the petitioner dated 10.8.2003 by a reasoned/speaking order in accordance with law within two months from the date of production of a certified copy of this order before respondent no. 3 by the petitioners. The petitioners shall submit a certified copy of this order before respondent no. 3 within a week from today.

With the aforesaid directions, this writ petition is finally disposed of. No order as to costs.
