Heard learned counsel for the applicant and learned A.G.A.
This application is filed by the applicant Kumari Sharda Devi with a prayer that the further proceedings of the Criminal Case no. 1271 of 2005, arising out of charge sheet submitted in case Crime 76 of 2004, under Sections 147, 148, 149, and 302 I.P.C. P.S. Karhal, district Mainpuri may be quashed.
From perusal of the charge sheet it appears that on the basis of the material collected by the I.O. during the investigation a prima facie offence is made out against the applicant, therefore, the prayer for quashing the further proceedings of this case is refused.
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant it is directed that in case the applicant appears before the courts concerned within 30 days from today and applies for bail the same shall be considered and disposed of expeditiously, if possible on the same day, in accordance with the provision of law. If any NBW has been issued against the applicant the same shall be kept in abeyance for 30 days only from today.
With the above direction the application is finally disposed of.
