This is an  application for bail moved on behalf of the applicant Rajendra   indicted in case crime No. 645 of 2006   under section 307  I.P.C. P.S. Kotwali City  District Bijnor.    

          Heard Shri Rahul  Kakran, learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that there is a cross case of the incident, the First Information Report which was lodged on 16.3.2006 at 1.05 hours co-accused Sher Singh sustained injuries in the same course of incident and was medically examined the same day at 7.40 P.M. The learned counsel submitted that in the X-ray report no bony injury was found.

The learned A.G.A. submitted that the applicant was armed with a lathi and the injury  kept under observation was on the skull and was inflicted by blunt object.

I have taken into consideration the submissions advanced on behalf of both the parties.

There is a cross case  crime no. 645-A of 2006 under sections 324, 452, 504, 506 I.P.C. the First Information Report of which was lodged on 16.3.2006 at 1.05 hours. One person each on both side sustained injuries in the same course of the incident and as a part of the same transaction. In the X-ray report of the injured no traumatic bony line was seen. In view of these facts, I consider it to be a fit case for bail.  

Let the applicant Rajendra   indicted in case crime No. 645 of 2006   under section 307  I.P.C. P.S. Kotwali City  District Bijnor , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
