Heard learned counsel for the applicants and learned A.G.A.
It is contended by the learned counsel for the applicant that the charge sheet has been submitted against the applicants under Section 494 I.P.C. whereas no offence under Section 494 I.P.C. is made out against the applicants.
Learned A.G.A. prays for and is granted 4 weeks time to file counter affidavit.
Issue notice to opposite party no. 2 returnable within a period of four weeks
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicants the further proceedings only against the applicants in case no. 992 of 2006, under Sections 498-A, 494, 323, 504 and 506 I.P.C. pending in the court of learned Additional Chief Judicial Magistrate,Court No. 2 Moradabad shall remain stayed till the next date of listing.
