This is an application for bail moved on behalf of the applicant Bhoo Dev involved in case Crime No. 248 of 2005 under section 2/3 of U.P. Gangsters and Anti Social Activities (Prevention) Act and section ¾ Gambling Act, Police station Raya, district Mathura.
Heard Sri Mithilesh Kumar Shukla, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that in the gang chart four criminal cases are shown against the applicant and the applicant is on bail in all four cases. The learned counsel submitted that co-accused Khajan Singh whose name appears at serial no. 1 of the gang chart has been granted bail by this Court by an order dated 30.1.2005 passed in Criminal Misc. Bail Application No. 1616 of 2006.
The learned AGA argued that the applicant is the member of gang and in case he is released on bail he will indulge in other criminal activities
I have taken into consideration the submissions advanced on behalf of both the parties.
In the gang chart four criminal cases have been shown against the applicant. The applicant is on bail in all four cases. Co-accused Khajan Singh has been granted bail by an order of this Court dated 30.1.2006. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Bhoo Dev involved in case Crime No. 248 of 2005 under section 2/3 of U.P. Gangsters and Anti Social Activities (Prevention) Act and section ¾ Gambling Act, Police station Raya, district Mathura, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
