It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He has not been put up for identification. The allegation against him is that some stolen articles were recovered from his possession. The recovery was not supported by any independent witness. He is in jail since 6.1.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Ravi @ Monu @ Tamanchi @ Sandip involved in Case Crime No. 12 of 2006 , under Sections 366 and 411 I.P.C., Police Station Bithri Banna Devi, District Aligarh be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
