This is an application for bail moved on behalf of the applicant Madan Pal, involved in case Crime No. 07 of 2006 under Section 3 R.P. (U.P.)  Act, Police station R.P.F. Post  Bareilly, district Bareilly.

Heard Sri Deepak Kumar Srivastava, learned counsel for the applicant, learned AGA and have perused the record.

The learned counsel for the applicant submitted that the offence is triable by the Magistrate Ist class. The contention of the learned counsel is that two sollar panel are said to have been recovered from the possession of the applicant. The learned counsel argued that the applicant has been falsely implicated due to enmity with the police.

The learned AGA argued that the applicant is arrested on the spot and the recovery of stolen property was made from his possession.

I have taken into consideration the submissions advanced on behalf of both the parties.

The offence is triable by the Magistrate Ist class. The applicant is in jail for the last three months. In view of these facts, I consider it to be a fit case for grant of bail.

Let the applicant Madan Pal, involved in case Crime No. 07 of 2006 under Section 3 R.P. (U.P.) Act, Police station R.P.F. Post Bareilly, district Bareilly, be enlarged on  bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
