Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant apprehended by the police and from his possession one stolen motorcycle was recovered on 30.11.2005. Till then no F.I.R. in respect of that motorcycle was lodged, but after recovery of that motorcycle the F.I.R. was lodged on 3.12.2005. The applicant is in jail since 30.11.2005.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Naushad involved in Case Crime No. 243 of 2005, under Sections 379 and 411 I.P.C. , Police Station G.R.P. , District Moradabad be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
