Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by the learned counsel for the applicant that the applicant and 2 other co-accused persons were apprehended by the police and on their pointing out one stolen motorcycle was recovered. The recovery was not supported by any public witness. Co-accused Sartaj and Bhoop have been released on bail by this court on 18.5.2006 in Criminal Misc Bail Application No. 9623 of 2006. The case of the applicant is on the same footing with the above mentioned co-accused.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Rajesh Sharma involved in Case Crime No.373 of 2006, under Sections 420 and 413 I.P.C., Police Station Nagfani, District Moradabad be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned
