Shishir Kant Sharma v. State Of U.P. And Others - WRIT - C No. 30140 of 2006 RD-AH 10370 (25 May 2006)
Hon'ble Yatindra Singh,J.
This is a writ petition for a direction to the respondents not to disconnect the electricity connection of the petitioner.
We have heard the counsel for the petitioner and Sri W.H. Khan for the respondents.
It appears from perusal of the record that no action is being taken by the respondents no. 1, 2 and 3 for disconnection of petitioner's electricity connection and actually there is a dispute between the landlord- respondent no.4 and the petitioner-tenant and the petitioner's allegation is that respondent no.2 by exercising undue influence upon the remaining respondents want to get the electricity connection disconnected so that the petitioner may be forced to leave the shop. This is a private dispute between the petitioner and the respondent No.4. Any how , since no action is being taken by the respondents no. 1,2 and 3 for disconnecting electricity supply of the petitioner at present , the writ petition is premature at this stage and is liable to be dismissed.
Needless to say that in case any action is taken against the petitioner, the respondents will give an opportunity of hearing to the petitioner.
With these observations, the writ petition is dismissed.
