Heard learned counsel for the parties.
I do not find any reason to review my judgment and order dated 4.8.2005 however time of nine months granted through the said order which expired on 4.5.2006 is extended until 31.7.2006 provided that by 31.5.2006 an amount of Rs.2000/- is deposited by the tenant before the prescribed authority for immediate payment to the landlord. In case aforesaid amount is not deposited then tenant must be evicted immediately after 31.5.2006 through process of court. However, if the aforesaid amount is deposited then no steps for eviction through court shall be taken till 31.7.2006.
It is further directed that in case the aforesaid amount is not deposited by 31.5.2006 then with effect from 1.6.2006 till actual vacation tenant shall be liable to pay damages at the rate of Rs. 50/- per day.
Similarly if after depositing the aforesaid amount of Rs.2000/- premises in dispute is not vacated by 31.7.2006 then damages for use and occupation shall be payable at the rate of Rs.50/- per day with effect from 1.8.2006 till actual vacation.
