Golia @ Rookam Pal v. State Of U.P. - CRIMINAL MISC. BAIL APPLICATION No. 6550 of 2006 RD-AH 10443 (26 May 2006)
Hon. (Mrs.) Saroj Bala, J
This is an application for bail moved on behalf of the applicant Golia alias Rookam Pal involved in case Crime No. 193 of 2005 under sections 364, 368, 120-B, I.P.C., Police station Baldev, district Mathura.
Heard Sri Rajesh Kumar Pal, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that all the co-accused have been granted bail by this Court by various orders and the case of the applicant is analogous to the co-accused Jagdish, Ram Prakash and Tilla. The learned counsel submitted that the abducted person is said to have been kept in the house of the applicant for a period of 8-10 days.
The learned AGA submitted that the applicant had confined the abducted person at his residence.
I have taken into consideration the submissions advanced on behalf of both the parties.
Co-accused Jagdish, Ram Prakash and Tilla have been enlarged on bail by orders of this Court annexed with the rejoinder affidavit as Annexures RA-1 to RA-7. The case of the applicant is similar to that of the co-accused. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Golia alias Rookam Pal involved in case Crime No. 193 of 2005 under sections 364, 368, 120-B, I.P.C., Police station Baldev, district Mathura, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
