This is an  application for bail moved on behalf of the applicant Hameed Kureshi   indicted in case crime No. 146  of 2006  under sections 3/5/8 of Cow  Slaughter(Prevention) Act   P.S.Barkheda  District Pilibhit.

Heard Shri Awadhesh Kumar Srivastava, learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that applicant is an old person and has no concern with cow slaughtering. The learned counsel submitted that applicant has been falsely implicated due to party fraction of the village. The learned counsel urged that slaughtering is said to have taken place on the roof of co-accused Sakeel.

The learned A.G.A. urged that applicant was arrested at the spot with the head of cow and blood stained knife. The learned counsel pointed out that recovery of axe, knife and pieces of beef was made from the spot.

I have taken into consideration the submissions advanced on behalf of both the parties.

The offences are triable by the Magistrate Ist class. The applicant is in jail for the last more than one month. There are no criminal antecedents of the applicant. In view of these facts, I consider it to be a fit case for bail.  

Let the applicant Hameed Kureshi   indicted in case crime No. 146  of 2006  under sections 3/5/8 of Cow  Slaughter(Prevention) Act   P.S.Barkheda  District Pilibhit, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
