Heard learned counsel for the petitioner and learned A.G.A. for the State.

This petition has been filed by the petitioner Mahendra Nath Yadav for quashing of the first information lodged at case crime no. 1290 of 2004 under Sections 302 and 427 I.P.C., police station Kotwali, District Basti.

From the perusal of the F.I.R.  prima facie cognizable offence is made out.

No ground for interference is made out. The petition is accordingly dismissed.
