The earlier writ petition filed by the petitioner practically for the same relief (paragraph 17 of the writ petition) was dismissed by this Court vide judgment and order dated 29.4.2005 with the observation that the proper remedy available to the petitioner is to initiate contempt proceedings. Counsel for the petitioner states that contempt proceedings were initiated however the petition has been dismissed.  Therefore, he has filed this writ petition.  

In the opinion of the Court this writ petition is misconceived inasmuch as the proper remedy available to the petitioner is to either approach the Division Bench of this Court against the judgment and order dated 29.4.2005 by way of Special Appeal or to approach the Apex Court against dismissal of his contempt application.

This writ petition stands dismissed.
