This is an application for bail moved on behalf of the applicant Veer Pal Singh, involved in case Crime No. 9 of 2006 under sections 325, 326, 332, 333, 353, 504, 506 I.P.C., Police station G.R.P. Shamli, district Muzaffarnagar.
Heard Sri Devendra Kumar, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that recovery of missing three insider teeth was not made from the spot. The learned counsel argued that the complainant is class one officer and the applicant is a class IV employee and the applicant having declined to perform domestic work the complainant has falsely implicated him. The learned counsel pointed out that there are contradictions in the first information report itself. The learned counsel submitted that the applicant is in jail for the last two months.
The learned AGA argued that the applicant subjected his superior officer to assault as a result of which his teeth were broken.
I have taken into consideration the submissions advanced on behalf of both the parties.
The recovery of broken missing teeth was not made from the spot. The offences are triable by the Magistrate Ist class. The applicant is in jail for the last two month. In view of these facts, I consider it to be a fit case for bail,
Let the applicant Veer Pal Singh, involved in case Crime No. 9 of 2006 under sections 325, 326, 332, 333, 353, 504, 506 I.P.C., Police station G.R.P. Shamli, district Muzaffarnagar, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
