Heard Sri R.B.Singh, learned counsel for the petitioners and Sri Vivek Singh, the learned counsel appearing on behalf of respondent Nos. 2 and 3.
The petitioners who were said to be employees on Daily wage basis engaged by the respondents have approached this Court by means of this writ petition under Article 226 of the Constitution of India, seeking a mandamus directing respondents to consider their claim for regularization in pursuant to the order issued by the General Manager, Jal Sansthan, Allahabad dated 25.1.1985. A perusal of the said order shows that the same was issued in order to give effect to the award dated 20.3.1982. The petitioners have also alternative remedy by raising industrial dispute under U.P.Industrial Disputes Act, 1947. In the circumstances this Court is not inclined to interfere with the controversy involved in this writ petition as the petitioners have efficacious and speedy alternative remedy by raising their disputes under the U.P.Industrial Disputes Act, 1947.
The writ petition is accordingly dismissed on the ground of alternative remedy.
