Heard learned counsel for the applicants and learned A.G.A.
This application is filed by the applicant Mohd. Shahid with a prayer that the NBW issued against him in Criminal Case No. 5044 of 2002, under Sections 323, 504, 279, and 337 I.P.C. pending in the court of Special Chief Judicial Magistrat, Allahabad may be quashed.
From the perusal of the record it appears that in the present case the applicant did not appear in the court concerned that is why the NBW has been issued against him,, so the prayer for quashing the NBW issued against the applicant is refused.
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant it is directed that in case the applicant appears before the court concerned within 30 days from today and applies for bail his bail application shall be considered and disposed of on the same day. If any N.B.W. is issued against the applicant the same shall be kept in abeyance for 30 days only from today.
With the above direction the application is finally disposed of.
