This is an application for bail moved on behalf of the applicant Raghunath arraigned in case Crime No. 210 of 2006 under sections 498-A, 304-B I.P.C., Police station Belipar, district Gorakhpur.
Heard Sri B.K. Tripathi, learned counsel for the applicant, learned AGA and have perused the record.
According to the prosecution the complainant's daughter (victim) was married to the applicant's son about five years before. It is alleged that the victim was subjected to cruelty on account of demand of colour T.V. and cash of Rs.10,000/- and was done to death by setting her to fire.
The learned counsel for the applicant submitted that the applicant is the father-in-law of the deceased and he gave information about the incident to the police the same day. It was argued that the victim sustained burn injuries while cooking food on stove. The learned counsel pointed out that the informant is one of the inquest witnesses but the first information report was lodged eight days after the incident.
The learned AGA conceded that the applicant is the father-in-law of the deceased.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant is the father-in-law of the deceased. General allegations of demand of cash and colour T.V. have been made against all the accused persons. The first information report was lodged eight days after the occurrence though the informant is one of the inquest witness. In view of these facts, I consider it to be a fit case for grant of bail.
Let the applicant Raghunath arraigned in case Crime No. 210 of 2006 under sections 498-A, 304-B I.P.C., Police station Belipar, district Gorakhpur, be released on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
