This is an application for bail moved on behalf of the applicants Shesh Nath Ram and Sanjay    indicted in case crime No. 96   of 2006  under sections 302, 201  I.P.C. P.S. Kasimabad  District Ghazipur.

Heard Shri V.K. Sharma, learned counsel for the applicants, learned A.G.A.  and have perused the record.

The learned counsel for the applicants submitted that the prosecution case rests on circumstantial evidence and the only circumstance against the applicants is that they on 10.4.2006 made an extra judicial confessional statement about the commission of murder before the village Pradhan Ram Parikha Yadav.

The learned A.G.A. submitted that the applicants made an extra judicial confession of their guilt before the village Pradhan

I have taken into consideration the submissions advanced on behalf of both the parties.

The prosecution case depends on circumstantial evidence and the only evidence against the applicants is their extra judicial confessional statement before the village Pradhan made two months after the commission of offence. The applicants are not named in the First Information Report. In view of these facts, I consider it to be a fit case for bail.  

Let the applicants Shesh Nath Ram and Sanjay indicted in case crime No. 96  of 2006 under sections 302, 201  I.P.C. P.S. Kasimabad  District Ghazipur, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
