This is an application for bail moved on behalf of the applicant Pappu involved in case Crime No. 23 of 2006 under sections 364, 302, 201 I.P.C., Police station Basrehar, district Etawah.
Heard Sri Umesh Chandra Mishra, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the applicant is not named in the first information report and the co-accused Manoj Kumar and Indra Pal who are named in the first information report have been granted bail by this Court. The learned counsel urged that the only evidence against the applicant is the joint extra judicial confessional statement of the applicant and co-accused including the accused named in the first information report
The learned AGA submitted that the applicant and co-accused kidnapped the complainant's son and after committing the murder threw away the dead body in the well.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant is not named in the first information report or in the statement recorded under section 161 Cr. P. C. The named co-accused Manoj Kumar has been granted bail by this Court by an order dated 4.5.2006 passed in Criminal Misc. Bail Application No. 8651 of 2006. The applicant and co-accused are said to have made an extra Judicial confessional statement before the Village Pradhan Risal Singh. In view of these facts, I consider it to be a fit case for grant of bail.
Let the applicant Pappu involved in case Crime No. 23 of 2006 under sections 364, 302, 201 I.P.C., Police station Basrehar, district Etawah, be released on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
A certified copy of this order be issued to the learned counsel for the applicant on payment of usual charges within 24 hours.
