Heard Mrs Swati Agarwal, learned counsel for the applicant, learned A.G.A. and perused the record.
Application has been field to stay the trial of S.T. No. 40 of 2005 under Section 302 IPC and Section 3(2)(5) SC/ST Act pending in the Court of Special Judge, SC/ST Act, P.S. Kotwali, District Fatehpur.
Contention of the learned counsel for the applicant is that the case is now being investigated by C.B.C.I.D. by the orders of the State Government and this fact has been admitted by the opposite party in its counter affidavit in para 4.
In the circumstances application is finally disposed of with the direction that further proceedings in above noted sessions Trial shall remain stayed during investigation being made by C.B.C.I.D. in the matter. C.B.C.I.D. Shall conclude the investigation expeditiously preferably within four months.
