Heard learned Counsel for the applicant and learned A.G.A.

It is submitted by learned counsel for the applicant that according to prosecution version 450 grams charas was  recovered from the possession of the applicant which is below commercial quantity. There is no compliance of the provision of the Section 50 of the NDPS Act. There is no public witness to support the recovery. The applicant is not involved in any other case of the NDPS Act.

      After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.

Let the applicant Hasim involved in Case Crime No. 56 of 2006, under Sections 18/20 NDPS Act  Police Station Chandi Nagar  District Baghpat be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
