Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the allegation against the applicant and other co-accused persons is that they fired at the police party, but nobody received any injury. It is further alleged that the looted currency notes were recovered from the possession of the applicant and other co-accused persons, but co-accused Sayed Meraj Ahmad has been granted bail by this court on 18.5.2006 in Criminal Misc Bail Application 9810 of 2006. The case of the applicant is on the same footing with the case of above mentioned co-accused.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Jitendra Tiwari alias Jeetu involved in Case Crime No. 169 of 2006, under Sections 147, 148, 149, 307, 411 and 34 I.P.C. and Section 7 of the Criminal Law Amendment Act, Police Station Kotwali, District Deoria be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
