Heard learned Counsel for the applicants, learned A.G.A. and Sri Neeraj Tripathi and Sri R.K. Gupta learned counsel for the complainant.
It is submitted by learned counsel for the applicants that the role of causing injuries did not assigned to the applicants. It is assigned to other co-accused.
It is opposed by the learned A.G.A. and learned counsel for the complainant by submitting that the applicants are having criminal antecedents.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and learned A.G.A. and without entering into the merits of the case, the applicants are entitled to be released on bail.
Let the applicants Dharampal and Sanker involved in Case Crime No. 110 of 2006, under Sections 147, 148, 149, 307, 504 and 506 Police Station , Kabrai District Mahoba be released on bail on his furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned with the condition that the applicants shall report to the court of learned C.J.M. concerned in the first week of each month till the conclusion of the trial. In default, it shall be open to the learned C.J.M. concerned to cancel the bail granted to them.
