Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicants that the applicant is not named in the F.I.R. He has not been put up for identification. The only allegation against him is that from his possession one stole file was recovered. The recovered was of daily used. The recovery was not supported by any independent witness. The applicants are in jail since 11.4.2006
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Nawab involved in Case Crime No. 99 of 2006, under Sections 394 and 411, Police Station Hathras Gate, District Hathras be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
