Ram Mohan Upadhyaya v. State Of U.P. Thru' Secry., (Secondary Education) And Ors. - WRIT - A No. 32960 of 2006 RD-AH 10727 (26 June 2006)
Hon. Tarun Agarwala, J.
Heard Smt. Kamla Singh, the learned counsel for the petitioner, Sri A.K.Dubey, the learned counsel for respondent No.5 and the learned Standing Counsel for respondent Nos.1,2 and 3.
The petitioner has challenged the order dated 19.5.2006 passed by the District Inspector of Schools whereby he has set aside the order of termination of respondent No.4.
In my opinion, the petitioner has no locus standi to challenge the order passed by the District Inspector of Schools. The order of the District Inspector of Schools, if any, can only be challenged by the institution through the Principal and not by the petitioner in his individual capacity.
The writ petition is dismissed.
