Heard learned counsel for the petitioner and Sri Manish Trivedi appearing for the respondent No.2.

The petitioner had filed Writ Petition No.23752 of 2006 which was dismissed by an order dated 3.5.2006. The petitioner has filed the present writ petition which is the second writ petition. In Writ Petition No.23752 of 2006 the petitioner has prayed for the following relief:

I.Issue a writ, order or direction in nature of mandamus, thereby directing the respondent Bank to release the Truck no.U.P.73A-1588 after accepting the instalment due upto date;

II.Issue a writ, order or direction in nature of mandamus, thereby directing the respondent Bank to accept the instalment of loan upto date and accept the rest of the amount as per agreement upto the year 2009.

III.Issue a writ, order or direction in nature of any writ, order or direction as deem fit and proper;

IV.Award cost to the petitioner of this writ petition.

The relief claimed in the present writ petition is quoted herein:

I.Issue a writ, order or direction in nature of mandamus, thereby directing the respondent Bank to release the Truck no.U.P.73A-1588 after accepting the instalment due upto date;

II.Issue a writ, order or direction in nature of mandamus, thereby directing the respondent Bank to accept the instalment of loan upto date and accept the rest of the amount as per agreement upto the year 2009.

III.Issue a writ, order or direction in nature of any writ, order or direction as deem fit and proper;

IV.Award cost to the petitioner of this writ petition.

In view of the aforesaid, the second writ petition for the same relief is not maintainable and is dismissed.
