This is an application for bail moved on behalf of the applicant Saddique indicted in case crime No. 9 of 2005 under sections 307, 504 I.P.C. P.S. Simbhaoli District Ghaziabad.
Heard Shri T.A. Khan, learned counsel for the applicant, learned A.G.A. and have perused the record.
On 23.1.2005 at about 9 A.M. the applicant is said to have opened fire at the informant's brother.
The learned counsel for the applicant submitted that injury is of grievous nature and the applicant is in jail for the last one and a half year.
The learned A.G.A. argued that role assigned to the applicant is of opening fire at the injured.
I have taken into consideration the submissions advanced on behalf of both the parties.
According to injury report (page 15 of the paper book) injury is of grievous nature. Looking to the nature of injury, I consider it to be a fit case for bail.
Let the applicant Saddique indicted in case crime No. 9 of 2005 under sections 307, 504 I.P.C. P.S. Simbhaoli District Ghaziabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
