Heard Sri Ashok Khare, learned Senior Counsel for the appellant.
It appears that the petitioner-appellant being aggrieved by the order of compulsory retirement filed Civil Misc. Writ Petition No. 24248 of 2006 which has been dismissed by the Hon'ble Single Judge on the ground of availability of alternative remedy. It is not disputed before us that the petitioner-appellant has an efficacious remedy before the U.P. Public Service Tribunal under Section 4 of the U.P. Public Service Tribunal Act, 1976.
Therefore, we do not find any fault in the order of the Hon'ble Single Judge. The appeal is, accordingly, dismissed. However, it would be open to the appellant to avail such alternative remedy provided under the Act.
