According to the case of the petitioners, their land in question of Khasra No. 500 and 502 has not been acquired. They have instituted a suit on that basis in which there is some interim injunction operating in their favour.
A letter has been issued to the petitioners on 16.9.2005 (Annexure-8), asking them to execute a sale deed after accepting certain amount of money. It has not been shown under which provision of law this notice has been given and what will happen if the petitioners refuse to comply with this notice. Accordingly, there is no occasion for this Court to intervene in the matter. However, the notice enclosed as annexure-8 may further tends to corroborate the case of the petitioners that the land in question has not been acquired, in which case the petitioners can conveniently seek their relief in the suit by way of interim injunction as well as final decree.
We, therefore, decline to entertain this writ petition, which is accordingly dismissed.
