Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the alleged occurrence had taken place in a sudden quarrel. It was not pre-intended. It is said that the applicant and other accused persons threw bricks. Consequently, 3 persons received injuries. According to their medical examination report all the injuries were simple in nature. It is further contended that it was alleged that a chain was also snatched , but during investigation it was found that no chain was snatched. The applicant is in jail since 3.5.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Kali Charan involved in Case Crime No. 50 of 2006, under Sections 147, 336 and 427 I.P.C. and Sections 3(i)(x) of the S.C./S.T. (P.A.) Act Police Station Chharra, District Aligarh be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned
