It is submitted by learned counsel for the applicant that according to prosecution version 60 grams nitrazepam was recovered from the possession of the applicant. There is no compliance of the provision of the Section 50 of the NDPS Act. There is no public witness to support the recovery. The applicant is not involved in any other case of the NDPS Act.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Manoj involved in Case Crime No. 115 of 2006, under Sections 21/22 NDPS Act Police Station Khair District Aligarh be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
