Smt. Prabhawati Devi v. State Of U.P. And Others - WRIT - C No. 18191 of 2006 RD-AH 10917 (4 July 2006)
WP No. 18191 of 2006
HON'BLE YATINDRA SINGH, J.
HON'BLE R.K. RASTOGI, J.
1. Petitioner was elected as a Block Pramukh in the last election on 12.4.2001. The petitioner took oath on 25.6.001. According to the petitioner, thereafter first meeting was held on 12.7.2001 and the petitioner is entitled to continue five years as Block Pramukh and as this is not being permitted, the present writ petition is being filed.
2. We have heard counsel for the petitioner, standing counsel and Sri PN Rai for the respondents. The respondent has also filed a counter affidavit in which it is mentioned that fresh elections took place and thereafter new office bearers have taken oath on 18.3.2006 and have assumed charge of the same. This writ petition was filed on 10th April 2006, much after the oath was taken by newly elected office bearers and they had started functioning. Even if the case of the petitioner is accepted, then only few days are left. In these circumstances we see no justification to issue any direction. The writ petition is dismissed.
