This is an  application for bail moved on behalf of the applicant Bhupendra Singh   indicted in case crime No. 29  of  2005  under sections 364-A, 368  I.P.C. P.S. Jagner  District Agra.

Heard Shri Ram Rawat, learned counsel for the applicant, learned A.G.A.  and have perused the record.

In between the night of 22/23-2-2005 at about 11.30 P.M. the co-accused Ram Rai, Rajveer and Deendayal along with their associates abducted Roop Singh, Prem Singh and  Om Prakash from the field of Subedar. Roop Singh one of the abducted persons was released by the culprits. The recovery of both the abducted persons was made from the jungle of village Bheatpura. The applicant and co-accused who were present on the spot managed to escape.

The learned counsel for the applicant submitted that applicant has not been named in the First Information Report. The learned counsel argued that no demand of ransom was made by the applicant. The learned counsel urged that applicant was not arrested on the spot.

The learned A.G.A. argued that both the abducted persons  named the applicant in their statements

I have taken into consideration the submissions advanced on behalf of both the parties.

The applicant is not named in the First Information Report . There is no specific allegation of demand of ransom against the applicant. The applicant was not arrested  from the spot of recovery. In view of these facts, I consider it to be a fit case for bail.  

Let the applicant Bhupendra Singh   indicted in case crime No. 29  of  2005  under sections 364-A, 368  I.P.C. P.S. Jagner  District Agra. , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
