Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that there was an agreement between the applicant and the first informant that the applicant shall execute sale deed in respect of land in favour of the first informant and for that purpose a cheque of Rs, 75,000/- was given to the applicant, but sale deed has not bee executed and it is alleged that the amount given to the applicant has been misappropriated. The applicant is in jail for more that 3 months.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Dindayal Sharma involved in Case Crime No. 301 of 2006 , under Sections 406, 352, 504, 506, and 467 I.P.C., Police Station Kasia, District Kushinagar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
