Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the F.I.R. is delayed by 17 days. The allegation against the applicant is that he used iron pipe blows on the head of the injured. There is no repetition of the blow. According to medical examination report no internal damage or fracture was found due to injuries received by the injured. The applicant is in jail since March, 2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Rajpal involved in Case Crime No. 306 of 2006, under Sections 308, 323, 504, 506 I.P.C, Police Station Nazibabad District Bijnor be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
