During the pendency of the writ petition, retiral benefits had been paid to the petitioner. However, the contention is that the petitioner is also entitled for payment of interest @18% per annum from the date when it became due till the date of actual payment, for which, the petitioner is relying upon the decision of the Apex Court in the Case of Vijay L. Mehrotra Vs. State of U.P. A.I.R.2000 S.C.3513. The petitioner has already made a representation on 26th June, 2003 before the respondent No.1 as well as respondent No.2 and submits that the said authorities, namely, respondent No.1 be directed to pass appropriate orders on the said representation.
Having heard learned counsel for the parties and after taking into consideration the facts and circumstances of the case, we dispose of this writ petition with a direction to the respondent No.1 to pass appropriate orders in accordance with law on the petitioner's representation dated 26th June, 2003 within a period of six weeks from the date of receipt of a certified copy of this order along with a copy of the said representation.
It is made clear that the Court had not adjudicated the matter on merits.
