Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the alleged occurrence has taken place in the dark hours of night at about 8 p.m. on 9.4.2006. It is said that the applicant and two other accused persons who were armed with rifle and country made pistol caused injuries on the person of injured. According to the medical examination report the injured had received two injuries out of which injury no.1 was found grievous. It has not been specifically alleged who caused that injuries. That applicant is in jail since 20.4.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Sheo Nandan Singh involved in Case Crime No. 73 of 2006, under Sections 307,323 I.P.C. Police Station Churkhi, District Jallaun be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned
