Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. The F.I.R. was lodged by Smt Rajabai Trivedi the wife of Mool Chand Trivedi. It was lodge against the co-accused Chandra Pal, Indra Pal and Rajju and during investigation it was found that the first informant Smt Rajabai Trivedi herself hatched the conspiracy to commit the murder of the deceased and according to prosecution version the role of catching hold is assigned to the applicant. He did not caused any injury on the person of the deceased.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Girija Shankar Awasthi involved in Case Crime No. 123 of 2006, under Sections 302 and 120-B I.P.C. , Police Station Kotwali Nagar District Banda be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
