Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the F.I.R. has been lodged after cremation of the dead body of the deceased. It is lodged on 13.4.2006 at 6.30 p.m. in respect of the incident which had occurred on 8.4.2006. The F.I.R. is delayed without any plausible explanation. The role of causing death of the deceased is not assigned to the applicant and he did not cause any injury on the person of the deceased.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Narendra Kumar alias Baba Ji involved in Case Crime No. 207 of 2006, under Sections 304 I.P.C. , Police Station Hari Parbat District Agra be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
