Heard learned A.G.A. for the State appellant and perused the impugned judgment.

It is contended by learned A.G.A. for the State appellant that the explanation of accused respondents regarding the injuries on the person of the deceased does not appear to be plausible as no information has been tendered in this regard, specially that there is demand of dowry and torture extended to her prior to the occurrence. The Trial Court has ignored the relevant facts with regard to the place of occurrence and the topography in this regard while passing the order of acquittal.

The leave to appeal is granted.

Issue notice to the respondents returnable within six weeks.

The respondents are directed to put in their appearance before the Court of C.J.M. concerned and file personal bond of Rs.30000/- and furnish two sureties in the like amount to the satisfaction of the court concerned. The C.J.M. concerned shall send compliance report along with photo copy of the personal bonds and surety bonds executed and furnished by and on behalf of the accused-respondents immediately thereafter. They are further directed to appear before this Court on 6.9.2006.

The office is directed to summon the trial court's record within six weeks.
