We have heard learned counsel for the appellant on the application for short-term bail mainly on the ground that the appellant's wife (Smt. Mohini Goswami) is suffering from Glomerulonephritis. In other words, she has some serious trouble in her kidneys and the doctor attending her gave advice to go to All India Institute of Medical Sciences, New Delhi for further investigation/treatment. It is, therefore, urged that the appellant may be released on parole for providing better treatment to his wife. The appellant's wife herself filed an affidavit in support of her application. It is also urged that the appellant's widowed mother expired on 7.7.2005 and there is none to look after appellant's wife except her minor son aged about 8 years. The appellant has been in jail since September, 2000.

We have considered the submissions made on behalf of the appellant. Keeping in view the serious ailment of the appellant's wife and with a view to provide her better treatment /investigation, we find it appropriate to release the appellant on short-term bail for a period of one month from the date of actual release from jail.

Let the appellant-Anil Kumar Goswami be enlarged for short-term bail for a period of one month which shall be reckoned from the date of his actual release from jail on his executing a personal bond and furnishing two sureties, each in the like amount to the satisfaction of C.J.M., Mathura in S.T. No. 582 of 2000 State Vs. Anil Kumar and others and in S.T. No. 581/2000 State Vs. Anil Kumar and others. The appellant shall surrender in the court of C.J.M., Mathura on 31st day after his release. The C.J.M. will take him into custody. It is also directed that one of the sureties furnished by the appellant shall be a near relative.
