Smt. Anita & Another v. State Of U.P. & Others - CRIMINAL MISC. WRIT PETITION No. 3511 of 2004  RD-AH 11134 (7 July 2006)
Issue notice upon respondent no. 4 within a week from this date.
Counter affidavit will be filed by the respondents by 14.8.2006. Rejoinder affidavit, if any, will be filed by 21.8.2006.
The matter will appear on 24.8.2006.
In the meantime, for the purpose of getting age proof, both the girl Smt. Anita and the boy Heera Rajbhar, (petitioner nos. 1 and 2 herein) will be produced before the C.J.M concerned along with their photographs, which will be attested by the subordinate officer of the C.J.M. concerned and then petitioner nos.1 and 2 will be sent to the Chief Medical Officer concerned along with the attested photographs for their identification and completion of ossification test, report of which will be produced before this Court on the next date of hearing by the learned Government Advocate. If any copy of the same is available with the petitioners, they can also file the same.
Today, petitioner Nos.1 and 2 both are present before this Court and they have been identified by the learned counsel appearing for the petitioners.
Till the next date of listing, petitioners will not be arrested in connection with Case Crime No.143 of 2004, under Sections 363 and 366 I.P.C., P.S. Ghosi, District Mau.
If, in the meantime, the charge sheet has been filed and/or cognizance has been taken, the interim order will not apply.
