Smt. Bhoore Begum & Others v. State Of U.P. & Others - CRIMINAL MISC. WRIT PETITION No. 3405 of 2004 RD-AH 11135 (7 July 2006)
None appears in support of the writ petitioner even on the repeated calls.
There are altogether seven writ petitioners. According to the counter affidavit, charge-sheet has been filed against petitioner nos.2,5 and 6 but the names of the petitioner nos.3,4 and 7 were expunged from their involvement. In any event, if petitioner no.1 Bhoori Begam is the victim, how she can be made petitioner in this writ petition is unknown to this Court. In the counter affidavit of respondent no.4, there is an annexure being Annexure CA-1, wherefrom it appears that there was post mortem report in respect of dead-body of Bhoori d/o Liaqat Ali. Therefore, this Court is unaware about facts and circumstances, as to whether ''Bhoori' is living or dead. However, since Bhoori is victim she can not be equated with the accused persons and made petitioners in the writ petition.
Therefore, the writ petition is dismissed.
Interim order, if any, stands vacated.
No order is passed as to costs.
