Heard learned counsel for the parties.
A very prudent question has arisen during the course of argument of the learned counsel for the parties that an amendment in the pleadings whatsoever, the nature of the same may be, will not cause irreparable injury or failure of justice to the other party aggrieved against it. On this point the case law of Prem Bakshi V. Dharam Dev, 2002 Supreme Court & Full Bench Rent Cases 209 has been cited upon which reliance has also been placed by the court below in the impugned order. In every case, permitting amendment in the pleadings would not cause irreparable injury to the other party, appears to be a ratio propounded in this case by the Hon'ble Supreme Court.
Learned counsel for the petitioners prays for and is granted time till Thursday i.e. 13.7.2006 to find out the case law on the aforesaid legal issue.
