In pursuance of order passed by this court on 2.3.2006 parties have compromised the matter before Deputy Collector/ S.D.O. The S.D.O Bisauli district Budaun through order dated 6.6.2006 accepted the compromise and dismissed the case making compromise dated 5.5.2006 as part of the order. The said order has been passed in case No. 22 of 2003.

Learned counsel for both the parties are present and stated that the said compromise was in fact filed before the Deputy Collector and Deputy Collector rightly decided the case in terms of the said compromise.

As the matter has been compromised hence this writ petition has become infructuous however it is directed that the parties shall strictly comply with the compromise dated 5.5.2006 which is made part of the order passed by the S.D.O through order dated 6.6.2006.

Accordingly writ petition is disposed of.
